American Revival PAC Ticketing Terms & Conditions By registering for this Event (the “Event”), Attendee hereby accepts these Terms and Conditions (“Terms and Conditions”) set forth by American Revival PAC (the “Committee”) and agreed to by the individual specified on the ticket registration (the “Attendee”). Committee reserves the right to change or modify any of these Terms and Conditions or any policy or guideline of the Committee at any time and in Committee’s sole discretion. Any changes or modification to the Terms and Conditions will take effect immediately upon posting to this webpage. Attendee waives any right to receive specific notice of such changes or modifications. 1. Admittance In its sole discretion, Committee reserves the right to refuse admittance to or expel from the Event any Attendee that it determines, in its sole discretion, is behaving in a manner that could be disruptive to the Event or pose any danger to any other attendee. Breach of any of the terms herein shall entitle Committee to all available legal remedies. Attendee hereby acknowledges and agrees that in the absence of any negligence or other breach of duty by Committee, Committee’s affiliates, and Committee’s staff, employees, and agents (collectively, “Released Entities”), entry to the Event and attendance at the Event is entirely at Attendee’s own risk. 2. Assumption of Risk To the maximum extent permitted by law, and except for instances of gross negligence, reckless conduct, willful/wanton conduct, or intentional acts by Committee and the Released Entities, Attendee hereby fully understands and knowingly, voluntarily and irrevocably, assumes all risks, hazards and dangers related to entry into, and presence in, at and around Event, including security risks. Attendee hereby accepts personal responsibility for Attendee’s attendance and participation in Event. To the maximum extent permitted by law, Attendee hereby assumes all responsibility of claims and potential claims relating to the risk, hazards and dangers, except for instances of gross negligence, reckless conduct, willful/wanton conduct, or intentional acts by Committee. 3. General Liability Release By registering for the Event, Attendee releases Committee and Released Entities from any liability whatsoever and waive all claims and causes of action arising from or related to this Event. 4. Release of Claims Attendee hereby and forever releases Released Entities from any and all claims arising out of or relating to any matter whatsoever that the Attendee may possess against Released Entities arising from any omissions, acts, facts, or damages that have occurred up until and including the date of execution of this release of claims. 5. Video/Photography Release Attendee understand photography, filming, and video and audio recording will occur at Event. Attendee hereby grants Committee, along with its agents and assigns, the irrevocable and unrestricted right and permission to use his/her name, image, likeness, and voice as recorded in photographs, films, videotapes and/or video recordings of Attendee in connection with Event in Committee advertising and promotional materials, and in any related materials, without compensation. Attendee agrees to waive any and all rights to royalties or other compensation arising from or in way related to the Committee’s use of Attendee’s name, image, likeness, or voice as recorded. Attendee understands and agrees that such photographs, films, videotapes and/or video recordings of his/her may be broadcast, displayed on satellite or cable television, printed, or distributed on the Internet or through other electronic means. Attendee also understands and agrees that he/she may be identified by name and/or title in printed, Internet or broadcast information that might accompany the photographs, films, videotapes and/or video recordings. Attendee waives any right to approve the final product. Attendee agrees that all such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all negatives, recording tape and digital files, including any and all intellectual property rights, are and shall remain the sole and exclusive property of Committee. Attendee agrees that Committee shall have the right to make subsequent use, commercial or non-commercial, of such photographs, films, videotapes and/or video recordings as Committee deems fit and without restriction. Attendee does hereby release, acquit and forever discharge Committee and Released Entities from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs, films, videotapes and/or video recordings, including but not limited to any claims for libel, slander, invasion of privacy, copyright or trademark violation, right of publicity, or false light. There is no time limit on the validity of this release and waiver, nor is there is any geographic limitation on the distribution of the aforementioned materials. 6. Personal Information By registering for Event, Attendee hereby consents to receive communications, including but not limited to phone calls, text messages, mail, and emails, from Committee to the contact information provided by Attendee. Attendee agrees to allow Committee to process all personal information provided in such registration and acknowledges that such processing may include such personal information being held by Committee on a database and, where legally permitted, being shared with other parties. Attendee agrees and acknowledges that any personal information submitted to Committee by Attendee in connection with the Event may be shared with Committee affiliates; Event sponsors; third parties providing services in connection with Attendee’s attendance at Event; and government entities and regulatory authorities as required by law. Attendee consents to their details being shared with such parties and agrees and acknowledges that such parties may contact Attendee in the future. All processing of personal information set forth in this section is subject to applicable data protection legislation. The use that any third parties make of Attendee’s personal information is outside of Committee’s control and, to the extent permitted by applicable law, Committee does not accept any liability in this regard. 7. Accompanying Minors Attendee may be accompanied at Event by his/her child(ren) or minor(s) under his/her legal guardianship below eighteen (18) years of age (“Accompanying Minor”). Attendee, on behalf of any such Accompanying Minor, hereby agrees to grant Committee, along with its agents and assigns, any and all rights contemplated in these Terms and Conditions. Attendee, on behalf of Accompanying Minor, further agrees to waive all rights and release Committee and Released Entities from any and all claims and liabilities contemplated in these Terms and Conditions. Attendee hereby attests that he/she is the parent or legal guardian of such Accompanying Minor, and therefore has the authority to grant such rights and make such waivers on behalf of Accompanying Minor. 8. Governing Law Attendee hereby understands and agrees that these Terms and Conditions will be governed by and construed in accordance with all applicable state and federal laws. 9. Enforceability and Severability Attendee hereby agrees that if any provision or part thereof contained in these Terms and Conditions is declared illegal, unenforceable, or ineffective, such provision or part thereof shall be deemed severable, such that all other provisions contained in these Terms and Conditions shall remain valid and binding. By registering for the event, Attendee acknowledges that Attendee has read and understood all of the terms of these Terms and Conditions, and Attendee is voluntarily giving up certain legal rights, including the right to sue the Committee and Released Entities.
